60s. the lows have been on the mild side. even though there's fog, a little mist and drizzle being reported. not too bad unless you are up in the higher elevations. we have a lot of low clouds and fog. a few high clouds, dragging across a few high clouds, making for a nice sunrise. it's also taken all of the tropical clouds and pushed it into the four corners. 58 in san francisco. we'll go a high of 70. that's 2 above average this time of year. most locations will be lows to their seasonal averages. 53 santa rosa. a lot of upper 50s and low 60s. i expect these to be the lows. we'll see warming tack taking place. morning, mist, driz. fog, sun, warm. these are pretty close to where they should be. 70s near the bay. here's sal. all right, steve. we're looking at the toll plaza, what generally everyone wants to see before they head out or at least the people in the east bay. you can traffic is backed up

for a 20, 25-minute delay getting into san francisco. that's your drive time, 20, 25 minutes. 880 northbound and southbound near the oakland com-- coliseum, this traffic is moderately heavy. no major problems as you drive past through. 880 past 92 will be a little bit slow. we can put it on the maps. i want to update the crash in daly city. northbound 1 to southbound 280 that ramp is blocked. it's causing slow traffic on highway 1 as you head down the hill toward the ceremony mall. 7:03. back to the desk. >> thank you, sal. happening today -- the city of san francisco says hello to paul mccartney and goodbye to candlestick park. workers are now busy finishing up work on the huge stage for the final event ever at the stick. there you see the picture there of some of the work being done. sir paul will close candlestick with a three-hour show at the former home of the 49ers and giants. ktvu's alex savidge joins us live with a preview of

tonight's historic concert at the stick. good morning, alex. >> reporter: good morning. this promising to be an emotional night for the music fans on hand and for sir paul mccartney himself. he has a lot of special memories. mccartney will perform in front of a huge crowd, an estimated 49,000 people should be on hand for the event, fitting, of course, for the former home of the 49ers. over the last couple of days, crews have been very busy, setting up the huge stage inside the stadium. it sits on what used to be the 10-yard line here. the concert promoter says this show will be a blast for fans. there will be a huge fireworks show, more than 900 pyrotechnics lighting up the night sky. and after tonight's explosions, the stadium will then face demolition in the coming months. the pk martny concert seems to be a perfect way to say goodbye. it was nearly 50 years ago when the beatles held their last paid concert at candlestick

park. that show was in august of 1966. now, music fans are gearing up for another big night. >> the stage is enormous. there a lot of specials going on and a lot of special video. we're trying to make the event, you know, really memorable. >> reporter: tonight's concert is officially a sellout, although, of course, you can find tickets on some websites like stubhub. seats down on the field for the concert tonight are going for $11,000. that's what we found and if you don't mind sitting up high and maybe not having a good view of the stage, you can get inside for about $100. the parking lot here at candlestick park opens up at 3:00 this afternoon. sir paul mccartney takes the stage around 8:00 tonight. he will be doing a long set for these fans. it's supposed to last about three hours. we're live this morning outside of candlestick park in san francisco, alex savidge, ktvu channel 2 news. >> all right. thank you, alex. more details now on some of the

memorable moments at candlestick park. opening day was april 12th, 1960. there's the vice president richard nixon, he threw out the first pitch. that's willie mays right there. in 1966, willie mays hit a career high 52 home runs. 28 of those were at candlestick park. also in 1966, the beatles played their final paid concert. they look so young, don't they, back in 1966? and then in 1967, pope pope -- pope john paul held a peace there and then two years later, there was the world series baseball game that many will never forget. [screaming] >> yeah. 1989, the loma prieta earthquake hit just before the bay bridge world series game between the as and giants was about to get underway. i was actually there in the stands.

higgins hugged and comforted each other at a vigil yesterday in dubose park. higgins had just died after being taken off life support. he was a member of a local lgbt group. he was brutally beaten sunday morning near dubose park. >> we just want him to be remembered for the type of person he was. he was very loving, very caring. all around a good human being. >> police say surveillance video shows he was beaten by a white man in his 20s, wearing a gray sweatshirt. as the investigation continues, there's still no known motive and it's not clear if this was a hate crime. it is 7:08. just days before school begins in san francisco, teachers are making plans for a possible strike. the big issue, money. teachers want a 21% ray paz over three years. the school district is offering 8.5%. tonight, teachers will vet son whether to authorize a strike. the next mediation session is

september 2nd. a big decision by the fremont district. janine de la vega joins us live to tell us what the fremont school district has done about a controversial sex education book that has angered many parents. >> reporter: at last check, 2500 parents signed an online petition urging the school district not to use a text book that parents say the graphic -- the content is too graphic for 9th graders. the school board voted and decided to back off on using the book. parents voiced their concerns to the school board members last night. they are upset the districts want to use a book called your health today because it contains references to oral sex, sex toys and bond an. 9th graders are required to take a class and learn about sex education. but the district admits this is meant for college students. they say teachers wouldn't knowledge on all topics. they decided to work with the

publicker to make changes on sex ed. here's what some parents told the board last night. >> you call yourselves professional, and if this was any other session that didn't meet code, you would pull it. i don't understand why we have to use this book. >> reporter: district officials say the book has not been used in california high schools before but only about 20 pages of the 400 are on sex. the district says they will hold off on using it until they get some more feedback. this issue will be revisited in january and then in the interim, the district has decided to go back to using the old healthtex books that they used last season for the upcoming school year. reporting live from fremont, janine de la vega, ktvu channel 2 news. 7:10. police in redwood city, say two massage parlors were really affront for prostitution. police arrested these three will. the person on the right is accused of running both

messages. many reciting several lines from their favorite williams's movie. as students head back to school, we're finding out more about just how much the recent wave of children from central america who crossed the border illegally could cost bay area tax payers. federal law says they have a right to be educated in u.s. schools. ktvu's kyla campbell live in washington, d.c. to explain who is picking up the tab. kyla? >> reporter: dave, the d of education sent me this fact sheet. they sent it to schools and states around the country. it says all children in the u.s. have a right under federal law to enroll in public k through 12 schools. more than 3900 immigrant kids have been placed in california's sponsored homes. the san francisco board of education says compared to this time last year, 250 more students enrolled in a special program that helps transition immigrant children. when it comes to paying for their education, the burden is on local and state tax payers. the federal government does not

cheaper deal. the fleet operates boats from san francisco to angel island and it's considering making a bid. mcdonogh said there's value in a locally based ferry service. >> as far as i know, we're the last family owned business. we try to keep our prices very low. >> it just seems so much more personal, so friendly. the faces you see on the website are the faces you see on the boat. >> the state is now saying when it will start accepting bids but it could happen as soon as november. some scary moments for 42 passengers on a ferry that was sailing from provincetown, massachusetts to boston. >> the boat is sinking. >> you don't want to hear that. i mean, big waves battered the ferry yesterday. sea water shut down the engine computer systems, even cracked some of the windows 20 feet above the water line. the captain's hand was cut. three coast guard boats rushed

to the rescue about three and a half hours later and with only one engine that ferry boat limped back to port. 7:18. we want to check in again with sal, see how things are going in the east bay. >> yeah, we're starting on 80, which is one of the big commute routes. obviously from the carquinez bridge. we'll take a look at vallejo in a second, too. but here between the carquinez bridge and the maze, about a 19- minute drive time. not bad. average speed below 60 miles an hour. there are no major problems. when you get to the bay bridge toll plaza, it's about a 15, 20- minute delay at the toll plaza. in fact, i think we do have a look at the toll plaza here and it's pretty normal. not all that bad. there is no baseball game today at at&t park. but, of course, you know, there's a big concert tonight at candlestick. i'm pretty sure that won't affect traffic too much during the day but maybe at night. let's move along. i want to mention highway 37 westbound driving from vallejo

over to marin. it's very slow. it's kind of been a pattern here to have it very slow all the way through. we move down to the center of the bay area at 92 and 880 is a little bit slow. 7:19 let's go to steve. >> thank you, sir. we do -- oh, boy. live tv, nothing like it. we do have a lot of low clouds around and also reports coming in from half moon bay, el granada, pacifica, mount davidson, ocean beach running cooler with more fog and a lot of reports with misty conditions here. that's a little bit of change we've seen in the last few days. there are a few high clouds and they are wrapping around the low up in oregon. watch how that drags across. mainly the santa cruz mountains east and south. there is a little bow low spinning out there. a lot of low clouds and fog around and that fog is also getting compressed a little bit. high pressure. so temperatures will bump up a little bit. they will be on the mild side. but actually very close to where we should be on seasonal

robbery. why school officials think this is part of a bigger problem.

p:24. officials -- 7:24. officials at sal poly obispo are investigating drug abuse on the football team. police say they believe a robbery was drug related. they say it bears a striking resemblance to a shooting last year involving a former cal poly football player and drugs. the five players posted bail and are due in court later this month. a bay area teenager now headed to tennis's u.s. open. she will be the youngest player there. 15-year-old cc is home schooled. mostly she practices in her back yard in atherton. that and her work ethic helped her win the girls 18 and under national title last week. it's a dream come true because it qualified her to play in the

u.s. open in new york later this month. >> i'm still kind of in shock that i'm going this year. i've been wanting to play since is what 7 years old. it's crazy. >> you tell them, cc. she says she doesn't feel any pressure to perform at the open because just getting there is a dream come true. she and her parents leave for new york a week from tomorrow. 7:26. happening today, state lawmakers will debate a bill that would require all california schools to have epi pens or auto injectors on campus and also train school staff volunteers in how to use them. the american academy of pediatrics says one in 25 children have severe food allergies. they say at least a quarter of the time, first-time allergic reactions occur at school and can be fatal within minutes. the state teachers' union is oppose esed to the deal -- opposed to the bill saying

show. just bundle up. it doesn't look brutally cold. temperatures will be in the upper 50s, low 60s. there will be more of a westerly breeze. we do have plenty of low clouds. a few high clouds. the low up in oregon continues to spin in a few of the clouds. high pressure kind of squashing it i think a little bit on the fog bank. 50s and 60s. also la fayette on the peninsula. 64 palo alto airport. but 53 la honda. 59 foster city and also belmont. mostly sunny, temperatures very close to seasonal average which is upper 70s for some upper 80s for others. 60s, 70s by the coast and bay. steve, we are looking at a commute now at the toll plaza that has been -- well, it's moderate. you can see 880 ramp is not as bad as it could be. this is about a 20, 25-minute drive time coming into san francisco. speaking of the city, of course, tonight's paul mccartney concert we've been talking about, the best way to get there is public

transportation. they are charging $40 -- i guess it's not unusual. but $40 at the candlestick lot there. you might want to think about using public transportation. take b.a.r.t. to the balboa station. they have muni to take you directly to the station. the traffic here is moderate lit heavy. we don't have the traffic commute going northbound. you can see a little bit of slowing as you drive into fremont. dumbarton/san mateo bridge, moderately heavy. a fire at a mall forced the evacuation of people. it happened at the valco mall. firefighters think it started on the third floor when equipment overheated in an elevator room. now, the mall had already closed when the fire started but there were people inside a gym and in that movie theater. >> i came here with my friends to work out at bay club, and

then we were in the hot tub and then all of a sudden, i was on facebook and i saw one of my friends post that there was a fire in valco. >> the fire was put out by sprinklers. there was water damage because of that. no one was hurt. a man accused of randomly stabbing another passenger on an a.c. transit bus is due in court today to face charges of attempted murder. it happened monday night while that bus was heading down san pablo avenue in berkeley. police say 24-year-old eric palmer walked down the bus aisle, pulled out a knife and said, watch this, before stabbing a young woman he didn't know. police arrested palmer as he got off the bus. that woman was seriously hurt but she is expected to survive. 7:33. trash collection become a bit of a messy situation over in oakland. the city has just awarded a $1 billion contract to a local recycling company. katie utehs joins us live from oakland to explain why there's concern and how homeowners will be affected.

good morning, katie. >> reporter: good morning, tori. homeowners' bills will go up regardless of who was going to get the contract. let me show you an example. you you can see the waste management and the recycling bins. but come july, california waste solutions will be taking care of all of the trash and recycling. the oakland city council approved a ten-year $1 billion garbage collection contract with cws. a texas company, waste management, has hemgd the contract for years -- hemed held the contract for years. your monthly bill will increase to 36.82 which was left than waste management's proposal. >> it may not be the lowest price but it may be the best value with the least amount of risk and in something that the city of oakland should really consider. >> reporter: it was something the councilman considered.

he voted no citing concerns as a small company to carry the load of all of oakland's trash. the company will have to improve infrastructure before they take over in july. now, within the last couple of minutes, i received a statement from waste management regarding the loss of the bid. they are not giving up that easily. the fight is getting dirty. they accuse cws of illegal dumping. coming up in my next live report, i will have more on waste management's statement following the loss of that contract bid. katie utehs, ktvu channel 2 news. >> thank you, katie. a tunnel in the hetch hetchy water system could be in danger of a catastrophic collapse which would cut off water to millions of people in the bay area. the san francisco chronicle reports city officials have known for more than two decades that the 19-mile tunnel outside of yosemite national park needs significant repairs. and repairs could cost more than $100 million.

replacing the tunnel, though, could cost $630 million. officials with the san francisco public utilities commission say the risk of a collapse is low but a bay area water agency has raised concerns about the stability of the tunnel which helps supply drinking water to 2.6 million homes and businesses in the bay area. meanwhile california voters will soon have their say on a new water bond. governor jerry brown reached the compromise with lawmakers from both parties on a 7.5 billion bond measure that will be on the november ballot. it will replace an 11 billion bond that lawmakers had already approved for the ballot but were worried wouldn't pass. if voters approve the new measure, it will provide funds for restoration work in the sacramento delta, flood prevention and new reservoirs. the plans for california's high speed rail project moving further down the tracks. the fresno bee reports that a second segment has been approved by a federal board.

that means construction on the 114-mile line between fresno and bakersfield can begin. now, the first section between fresno and merced that was approved last year. but the $68 billion project still does not have full funding. earlier this month, aup ruled that the -- a judge ruled that the state can start selling $8 million in bonds approved by voters in 2008. some critics say the current project no longer resembles the original plan that voters approved. 7:37. today is the deadline for state lawmakers to take action on two proposals for new regulations on ride sharing companies. the proposals come from the state assembly and would set strict new requirements for insurance, background checks, and drug and alcohol testing of drivers. companies like lyft, uber and side car say the proposals sifl innovation. they say lawmakers are caving in with pressure from taxis and insurance companies. 2 investigates has

uncovered major problems with parking tickets in san francisco going to the wrong hands. drivers from all around the state tell us they have received notices saying they owed money for a violation that was not theirs. some people had never even visited san francisco and they say when they tried to contact the city or the collections agency, getting the error corrected was next to impossible. >> when you do finally reach someone, they are like i'm sorry, you owe the money, period. no matter how much i said i don't own the car, i didn't own the car. they said, well, you have to send us some sort of proof that you don't own the car and they were completely inflexible. >> today at 5:00, the sit's reaction to the problem and why it says the collection notices are not exactly what they are seeing. we're following breaking news in hayward. firefighters now battling a house fire. it's happening on park arroyo police near mount eden high school. so far, no word of any injuries. now, ktvu has a crew on the way

there. we'll bring you a live report coming up. time now 7:38. a rally will be held this afternoon at frank ogawa plaza. it will be at 4:00 this afternoon. it's in solidarity with the protesters in ferguson, missouri taking to the streets claiming police abuse. now, last night in ferguson, police fired tear gas to break up another demonstration there. it was the fifth straight day of protests after the deadly police shooting of 18-year-old michael brown last saturday. news crews are out there covering the protests. they were caught in the middle of that confrontation. tear gas canister went off a couple of feet away from a tv reporter there and his photographer. they had to run away. two other journalists were arrested hours earlier after videotaping police at a mcdonald's restaurant. one of the reporters who works for the huffington post tweeted these pictures you are seeing of their arrest. both reporters say they were

handled roughly by police. neither reporter was cited and they were later released. you may recall that a ktvu news crew was hit by tear gas at a protest three years ago. >> let's go. let's go! julie, i'm running to the truck right now because they've just put off another round of tear gas out here. >> that's the voice of ktvu's jana katsayama. she was covering an occupy rally when police put out tear gas. 20 minutes before 8:00, a contra costa judge has told jurors to keep deliberating in the molestation case against former elementary schoolteacher, joseph martin. etch faces more than 100 charges involving 14 accusers. jurors have been deliberating

camp for the refugees. israel and hamas have agreed to a five-day extension of the cease-fire. israel and palestinian delegations have been negotiating in egypt with the goal of achieving a long- lasting peace agreement. more than 1900 palestinians have died in the current conflict. 67 have been killed on the israeli side. 7:44. in an exclusive interview with ktvu, we hear from a young man who almost lost his life. he was shot on the streets of campbell by a man trying to rob him and his girlfriend. pam cook is in the studio with the incredible story and why police need your help. >> it happened after midnight in early august in an area even police say is very safe. >> i was laying there about to die. >> 31-year-old john then penn was heading home from a night out with his girlfriend when a gunman tried to rob them near the pruneyard shopping center in campbell. he demanded money, then wowpt waiting for much of a response

fired several shots at penn. one bullet narrowly missed his heart and stopped at his spine. >> he shot me a couple of times. he decided that wasn't enough. so he tried to shoot her, too. >> his girlfriend was treated and released from the hospital. but penn has been there since the shooting august 3rd. doctors say he will probably have a hard time walking for a while. campbell police also tell us this is a high priority case. they are following up on several leads but so far no arrests and they do need your help. here is a sketch of the suspect. take a good look. he's described as a latino man in his 20s or 30s. but officers tell us that it appears this man also robbed another woman at the second street garage that same night. tori? >> thank you, pam. one of the finalists for chief of police in east palo alto is facing two lawsuits alleging police ms conduct. that's a -- misconduct. the paper reports retired san jose police captain brian ferrante is a defendant in a

2010 lawsuit accusing hill and another officer of wrongful arrest. a judge dismissed the lawsuit in 2012 but it's now being appealed. a second lawsuit involves ferrante and 14 other officers. the plaintiffs were allegedly renting space to a medical marijuana facility but say they were subject to an illegal search. 7:46. let's bring sal back, get you to where you need to go. the east shore, how does it look? >> it's not quite too bad. i will switch it out. i will bring it up on the big screen. you can see 24 minutes. we started at 18. i wouldn't say i would be worried but you are going to take a little bit more time to drive through. the average speed is down a little bit from last time to about 50 miles an hour. all in all, not a bad commute. when you get to the bay bridge toll plaza, it's backed up to the macarthur maze and the metering lights are on. and this is a live look here. it's about a 25, 30-minute drive time into san francisco.

there are no major problems getting through the city this morning. i want to take a look at 880 southbound which has been slow from hayward down to fremont. you will see some slow traffic here. trying to pin a drive time on the map. it's about 22 minutes to go from 238 to thornton avenue. then across to the bay, across the bay to the peninsula, 101 and 280 not looking all that bad. here we are and traffic is i would say moderate for this thursday. it's 12 before 8:00. let's go to steve. >> all right, sal, thank you. are we at candlestick in the fog? yes, i do believe. thank you. it won't be that bad tonight. always take a jacket. it will probable -- upper 50s, very low 60s. there will be fog clearing. you know there will be a breeze around somewhere. it could be worse. but there is a little bit more in the way of nothing today a little bit more mist, drizzle. low clouds have been up there. they are down. that's usually a sign high pressure is squashing things. a little band of high clouds.

welcome back. 7:54. the family of the teenaged girl run over by first responders after the asiana crash filed a wrongful death lawsuit against the city of san francisco. the 16-year-old was lying on the ground near the plane when firefighters rushed to the crash scene on july 6th of last year. federal investigators ruled that the teenager died after being run over by emergency vehicles. now, the lawsuit is claiming rescuers were poorly trained and reckless and the family is seeking unspecified damages. 7:54. the bay area woman known as a

serial stowaway has been ordered to spend six months in jail for violating her probation. marilyn hartman pled no contest last week to sneaking onto a southwest airlines flight from san jose to los angeles. a judge released her and told her to stay away from the airport if she did not have a legitimate ticket. but the next day she was arrested again at l.a.x. hartman was given a stayaway order and two years' probation after trying to at least six times to board planes at sfo. hartman was able to get through security and board a plane without a ticket at mineta san jose airport just a few months after a 16-year-old from santa clara hopped a fence there and sod away in the wheel -- stowed away in a wheel well. the san jose city council is to hold an airport security

meeting hearing next month. [inaudible] >> the airplane security hear something september for september 25th. this morning, some people in contra costa county are facing internet problems for a third day in a row. at&t says it's working to prepair extensive damage to a fiber cable that was cut on tuesday. it knocked out phone and internet service to many people in martinez including county buildings, schools and even the chp offices. the 911 emergency lines, though, were not affected. at&t says most of the service has been restored and it is working to restore all service as soon as possible. 7:56. a 14-year-old runaway in texas was found after he hid inside of a walmart for more than two days. police say he had two hideouts in that store.

one behind some baby strollers. the other behind paper towels and toilet paper. and he changed his clothing every couple of hours to avoid attracting attention. he even wore diapers so he wouldn't have to use the bathroom. police are still investigating why he reported running ayou way -- running away. breaking news. we have a news crew heading to a house fire in hayward. we'll have an update. also, a sex ed book that critics say went too far. the late night school board vote, the one that closed the book on that controversy. >> reporter: plus saying goodbye to candlestick park with a very special performance by sir paul mccartney later tonight. it will be the stadium's final event. we'll tell you how the artist is planning to send off the stick with a bake -- with a bang. this morning we're looking at a commute where traffic is

than not enough. the fog and low clouds with us. the low responsible up north will keep temperatures from getting too warm or too cool. it's kind of hanging around here. it will eject out. 57 to start in san francisco. that's a little bit warmer -- a little bit cooler i mean than we've seen lately. low 60s. pittsburg is in there. san ramon, 59. castro valley 58. on the peninsula, 59. belmont, la honda is running a few degrees cooler. 53. palo alto airport says 64. overall, the tropical clouds are gone. for the first time in a long, long time. so fog, sun, warm away from the coast. a little bit cooler over by it. but temperatures, 60s, 70s and upper 80s. temperatures are close to seasonal average. here's sal. we're looking at a commute that's better in some areas. and just at the peak in others. let's start off with a look at 880. this is when it usually gets busy on 880 heading north. just about 8:00. someone once told me and they probably are right, these are a

lot of the court workers that come up to downtown oakland. court starts at 9:00. they get there about this time. this is the crowd heading there. this has been the trend. let's move along to the bay bridge toll plaza, the traffic here looks pretty good as you head up -- for the morning, it's 25-minute drive to get in san francisco. san jose and the south bay, 280 is slow through 17 and 85 is slow into saratoga. it has not been all that bad. northbound 101 near de la cruz there is a crash reported. back to the desk. we're continuing to follow breaking news in in hayward where firefighters are battling a house fire. it's happening on park arroyo place near mount eden high school. no reports of injuries. it's a little bit south of 92 and east of 880 in this map here. ktvu's katie utehs is at the scene and will have a live report for us in a few minutes. happening today, at a countdown to the final event ever at candlestick park. sir paul mccartney will close

candlestick with a three-hour show at the former home of the 49ers and giants. ktvu's alex savidge joins us live with more on tonight's historic concert at the stick. good morning, alex. >> reporter: tori, good morning to you. you know, mccartney was just here performing at outside lands last year. but he decided to return because he has so many special memories of candlestick park. he will be taking the stage tonight in front of a huge crowd, estimated to be around 49,000 people here at candlestick park. sort of fitting, you could say, for the stadium that was once the home of the san francisco 49ers. crews over the last few days, they've been hard at work building up a huge stage. the concert promoter said the stick will be going out with a bang tonight. there will be a huge fireworks show. pyrotechnics lighting up the school. it was almost 50 years ago when the beatles held their last

paid concert. that show in august of 1966. now music fans are gearing up for what promises to be another amazing night and in a video message posted on his website, mccartney promised a special show. >> gonna be a very emegsal night. it will be a great night. we're gonna rock. i have very special memories, as you know. >> reporter: tonight's concert is officially sold out. you can find tickets on sites like stubhub. seats down on the field, $11,000 is what we saw. you can get some that are cheaper that run you about $100. but those indicate that you won't have a few on the stage. if you are okay with that and just want to be inside, there you go. there's a cheaper alternative. the parking lot will be opened up here to fans who want to come early at about 3:00 this afternoon. mccartney takes the stage at 8:00 for what is expected to be a long set, three hours he will be performing here tonight. we're live outside of

candlestick in san francisco, alex savidge, ktvu channel 2 news. new this moimping, the chp believes -- this morning, the chp believes alcohol was a role in a deadly accident. the suv veered off the highway, hit a guardrail and slammed into a tree. the driver was pronounced dead at the scene. while we don't know his name, he was described as a 32-year- old man from the heeldsburg area. several lanes near todd road were closed for about two hours after this crash. san francisco police hope surveillance video will lead to the person who bra tally attacked a man in what is now a homicide case. the family and friends of 31- year-old beating victim brian higgins hugged and comforted each other at a vigil yesterday afternoon in dubose park. higgins had just died after being taken off life support. he was a member of a local lgbt group and was brutally beaten

sunday morning near dubose park. >> i just want him to be remembered for the type of person he was. he was very loving. very caring. he is an all-around good human being. >> police say surveillance video shows that higgins was beaten by a white man in his 20s wearing a gray sweatshirt. as the investigation continues there's no known motive and it's not clear if this was a hate crime. we want to update you on the breaking news we first reported about half an hour ago. firefighters have been battling a fully engulfed house fire in hayward. ktvu's katie utehs just arrived on scene moments ago. katie, is the fire out? >> reporter: at this point, firefighters have knocked down the flames. the investigation now begins. they tell me that it may have started in the kitchen. you can see this is a two-story family home. we've been told that everybody made it out okay.

but from what we can see there is extensive damage. you can see firefighters going through the house at this point. there appears to be a lot of things in this house. it's quite packed with boxes. the garage is stuffed full of household items. so fortunately, everybody made it out okay. i'm told the fire started around 7:00 a.m. in this two-story home. we're near mount eden high school. this is the 2000 block of park arroyo place. it's a narrow corridor -- or narrow street to get down here to the house. but firefighters put on the the flames in about a -- put out the flames in about a half an hour's time. we're told this was a fully involved fire damaging much of this home. we'll touch base with investigators to see if they are close to determining the cause. they say it appears the fire may have started in the kitchen. we'll walk over and try to talk to them. so if they can give us any insight as to what happened this morning. live in hayward, katie utehs,

ktvu channel 2 news. 8:08. a big decision by the fremont school district. janine de la vega joining us live now to tell us what the fremont school board has done about a controversial sex education textbook that made a lot of parents angry. >> reporter: this struck a nerve with a lot of parents. they say some of the content in this book is too racy for 14- year-olds. this was debated for several hours at the school board meeting yesterday. and ultimately the board decided late last night to delay the decision. representatives from the fremont unified school district got an earful from parents who were upset that the textbooks called your health today contains references to masturbation, sex toys and bondage. the school board wants to work with the book's publisher to makes changes in its chapters on sex education so it's more suited to 14 years old.

here's some comments from parents and a board member. >> just because there's accurate information in this book does not mean it's good or healthy information for our 13 and 14-year-old children. >> we need to have this book for those kids that need it. so please, keep with what we have. >> reporter: district officials say the book has not been used in california high schools before but only about 20 pages of the 400 are on sex. they have argued that teachers wouldn't teach every single page, just relevant items. hundreds of parents have signed a petition calling for the book's removal. the district says they will hold off on using the books until they get some more feedback. this will be revisited in january and in the interim the school district is going to have the students use last year's health book for this upcoming school year. reporting live from fremont, janine de la vega, ktvu channel 2 news. days before school begins in san francisco, teachers are making plans for a possible

strike. the big issue, money. teachers want a 21% pay raise over three years. the school district is offering 8.5%. tonight, teachers will vote on whether to authorize a strike. the next mediation section is scheduled september 2nd. it is coming up on 8:11. out with the old, in with the new. coming up in 25 minutes, the risk behind a billion-dollar move that kicked oakland's long- time garbage collection company to the curb. plus, as more students get ready to head back to school, we're live in washington, d.c. with the special instructions going out to schools all over the country on how to deal with thousands of immigrant children from central america. good morning. we're still looking at a commute that has some rough spots as we look at 237, stop and go getting into the valley. we'll tell you more about the morning commute and the bay weather. plenty of fog out there. it looks to be more on the emphasis of fog compared to the past couple of mornings.

genie in the disney animated movie. from coast to coast, theaters bid robin williams a pointant -- poignant farewell. williams appeared on broadway a few times. in hollywood, the world-famous chinese theater also dimmed its lights for both williams and legendary actress lauren bacall. she died on tuesday. this is only the 8th time the landmark broadway palace dimmed its lights in over eight decades. bay area memorials are continuing to grow for williams. people from around the world have flocked to the san francisco house depicted in his film mrs. doubtfire. people have left farewell messages at the memorial.

many recite lines from their famous movies. it's back to school time. this school year, thousands of immigrant children from central america who entered the u.s. illegally are guaranteed a public education under federal law. ktvu's kyla campbell, live in washington, d.c. to tell us the price tag in who is paying the -- and who is paying the bill. kyla? >> reporter: well, dave, the department of education sent me this breakdown of what it cost to teach students in california, and it averages out to more than $9500 per student each year. the san francisco board of education says compared to this time last year, 250 more students enrolled in a special program that helps transition immigrant children. so do the math, and that school district could shell out an additional $2.3 million to educate the undocumented children this year alone. federal law guarantees migrant children a public education while they await immigration court proceedings.

role and state tax payers pick up the added costs. >> you get some federal money for education but because you pick up raufer, -- the tax payer costs could go higher. if you add up all of the students who have been released to sponsor homes in the state of california, their education could cost an extra $37 million this year alone. live in washington, kyla campbell, ktvu channel 2 news. thank you. 8:17. arizona state university lineman edward sarafan is speaking out after confirming he's gay. sarafan made the announcement in a phoenix magazine and says he told his teammates last spring. he's the first college football player to come out while an active member on a team. st. louis rams linebacker michael sam came out publicly but it was after ending his final season at the university

of missouri. 8:17. sal is coming back. you are watching highway 24 and everything else. >> that's right. good morning. we're starting off as you mentioned in the east bay. take a look at highway 24. you can see traffic is moderately heavy. a little bit of slowing here at the la fayette b.a.r.t. station. after that it looks okay at the caldecott tunnel. we're looking at the maps. the rest of the east bay, you can see slow traffic heading south from fremont. a lot of slow traffic on the dumbarton bridge. let's go to the bay bridge toll plaza, the traffic looks pretty good as you drive across the bay. no major problems. also looking at about a 25, 30- minute delay here getting into the city. i also want to mention 580 westbound through livermore. see some slow traffic from livermore to pleasanton and after that, slight slowing into castro valley. 8:18. let's go to steve. a lot of low clouds around. some breaks in the low clouds. a lot of reports coming in

today, a little bit more in the way of fog and more misty and cooler especially from ocean beach to oakland. tonight, bundle up. wear the layers. better too many than not enough if you are heading to candlestick park. we don't have an offshore breeze. there will be fog around and a westerly breeze. low clouds are here. the high tropical clouds are gone. i mean, there is a little ban sweeping in. that came in off the pacific wrapping around the low which parked itself up into washington and oregon. a little unusual for this time of year to see that. we haven't had much in the way of that this summer. it took the tropical moisture and finally kicked it all the way out of arizona and almost out of utah. that's not something that we've seen for a long, long time. there is a little low. series of lows, meandering around the next five, seven days. some of these might give us a cooldown and they back off. temperatures settle down, i think in a fine range. oakland starting off at 62. 75 for a high today.

pleasanton, 87. there will be a little bit of a breeze behind that. 51 this morning in calistoga. 53 reported at petaluma. all pretty close. even surface to higher elevations. 60s for some. some of these are pushing up in the mid- to upper 60s. water temperatures continue be to be in the 60s. 52 in tahoe. they were 44. it was 20 degrees cooler than yesterday morning. it will be 71 for a high in detroit. that's the temperature they should see september 24th. speaking of the tropical cloud deck, where is it, it's going farther into the four corners. denver getting a taste for what we've had. fog, sun, warm for sun. maybe cooler favoring areas closer to the west. there will be a few mid- to upper 80s especially away from the coast. this will be more of a typical

8:24. police in redwood city say two massage parlors in the city were actually fronts for prostitution. police arrested three women. the person on the right is accused of running both businesses and brothels. the other two women face prostitution charges. in the past three weeks, undercover officers were solicited for prostitution and the at the aroyia spa and the spa on el camino.

neighbors started to complain. >> saw girls walking here. very pretty girls. they come over here around 10:00 a.m. >> redwood city police are now looking at the business licenses and permits of both spas. 8:24. the family-owned business that runs a ferry boat service between tiburon and angel island may be in jeopardy. maggie mcdonogh's father started the service in 1959. it's the only way to get from angel island to marin county. now the park service wants a cleaner deal for that two-mule route and it's taking bids. the blue and gold operates boats that sale from san francisco to angel island. it's considering making a bid. mcdonogh said there's value in a locally-based ferry service. >> we're the last family owned and operated service. we have one center of revenue taking people to angel island. we try to keep our prices very low. >> it seems so much more personal. the faces you see on the website. are the faces you see on the

boat. >> they are not saying when they will start to accept bids but it may happen in november. there were some frightening moments for 42 passengers on a ferry from provincetown, massachusetts to boston. >> the boat is sinking. >> giant waves battered the ferry yesterday. the sea water shut down the engine computer systems and even cracked a pair of windows 20 feet above the water line cutting the captain's hand. >> at some point, i thought i was gonna die. >> we were out in the middle of the ocean. we were all pretty scared. we didn't know what was gonna happen. >> three coast guard boats rushed to the rescue about three and a half hours later. with only one engine, the ferry limped back to port. 8:26. i'm sure you've seen it online. the ice bucket challenge. now mark zuckerberg is getting in on it. his icy execution and nominations right after the break.

this all happened about 10:30 at the vallco shopping center on wolfe road. brian flores, you are there. tell us about the damage and whether some businesses will be affected. >> reporter: hi, dave. good morning. several people obviously come to the mall to shop. for those who were here late last night at the gym as well as this movie theater right behind me, these are the people that had to be evacuated last night because of this fire. i want to go to the scene. this is video after 10:30 as several crews responded to this two-alarm fire. a battalion chief tells cute the fire started in the -- ktvu the fire started in the third floor of the mall when electric overheated. witnesses say fire and what appeared to be oil was on the ground. the fire department says the sprinkler systems kicked in because of the smoke and was able to help put on the the fire before the -- to help put out the fire before the

firefighters arrived. >> the lights went out, the fire alarm came on. there was an announcement, attention, attention, there is an emergency in the building. please evacuate. >> i came to work out with my friends at bay club. we were in the hot tub. i was on facebook and i saw one of my friends post, there was a fire in vallco. >> reporter: the stores had closed at 9:00 p.m. so the shoppers were not affected. there was a little bit of water damage, however, near the theater as a result of the sprinkers going off. we -- sprinklers going off. we tried to call mall officials. we've into the heard back. it appears the -- we've not heard back. it appears the mall will be open this morning. there are no reported injuries. brian flores, ktvu channel 2 news. 8:33. a man accused of randomly stabbing another passenger on an a.c. transit bus monday night, he's due in court today to face charges of attempted murder. this happened while the bus was heading down san pablo avenue in berkeley. police say 24-year-old eric

palmer walked down the aisle of the bus pulled out a knife and said watch this before he stabbed a young woman he didn't know. police arrested palmer as he got off that bus. the woman was seriously hurt. but she is expected to survive. 8:33. oakland city council officially tossed out the city's long-time garbage collection company after a long battle for the $1 billion city contract. the council approved california waste solutions to be the city's garbage company starting next july. right now, that company provides just some of the recycling surface in oakland. before the vote, cws and supporters say having a local company would be historic. >> people have worked in the community for 22 years. we believe we always had the local advantage. >> given the opportunity for a local company and minority company to make history. >> but waste management says

choosing a small oakland company comes with a risk. cws will not be ready to take on the full job in time. waste management says there will be extra costs and potential environmental downside. but cws says it will be ready next year and it will improve current service levels. more details now on that contract. bids from both companies included rate hikes. but cws had the smaller increase of 23%. california waste solutions says customers will pay $36.82 each month. a tunnel in the hetch hetchy water some could be in danger of a catastrophic collapse which could cut off water to millions of people in the bay area. the san francisco chronicle reports city officials have known for more than two decades that the 19-mile tunnel outside of yosemite national park needs significant repairs. those repairs could cost more than $100 million. replacing the tunnel, however,

would cost $630 million. officials with the san francisco public utilities commission say the risk of a collapse is low but a bay area water agency has raised concerns about the stability of the tunnel which helps supply drinking water to 2.6 million homes and businesses in the bay area. california voters will soon have their say on a new water bond. governor brown has reached a compromise from lawmakers on both parties on a 7 billion bond measure. it will replace an 1 -- an 11 billion bond. 8:36. the plans for california's high- speed rail system. they are moving farther down the tracks. the fresno bee reports a federal board approved the

second segment. that means construction could begin on the 114-mile line between fresno and bakersfield. the first section between fres know and merced that was approved last year. however, the $68 billion project still is not fully funded. earlier this month, a judge did rule that the state could start selling $8 billion in bond approved by voters in 2008. some of the critics say the current project no longer resembles the original plan that voters approved. 8:37. if you have been on facebook, twitter or instagram, you've probably heard about the ice bucket challenge. the latest celebrity to accept the challenge to dump a bucket of ice on himself or donate $100 to als is mark zuckerberg. >> here we go. that was really cold. time now, 8:426789 we have developing news in hayward where firefighters put out an early-morning house fire. it happened near a high school. this happened about 7:00 a.m. these are developing pictures. this is where it happened. ktvu's katie utehs live outside of the home where the crews there quickly put out the

flames. katie? >> reporter: well, dave, i'm happy to report that everybody made it out all right. there are several heroes involved this morning. a construction worker that brought a ladder to the family and then a 9-year-old girl who helped her family escape from the roof with what she learned from school. she learned how to escape a fire while in school. hayward firefighters say around 7:00 a.m., a fire sparked possibly in the kitchen of this two-story home. six people live here in three bedrooms upstairs, where everybody was residing this morning. they were trapped by the choking smoke. they tried several times to get down the stairs but the smoke was too thick. the 9.5-year-old girl she heard the fire alarm and immediately sprang in action. >> he said there was a fire. i quickly got a towel and wet

it. my dad tried to go downstairs but there was too much smoke so we climbed out of the window. >> reporter: this home is located on park arroyo place near mount eden high school. firefighters say they did have some chaps putting out the fire. the personal items hindered efforts. there is a bit of a hoarding situation here with a lot of hallways being jam packed with stuff. however, everybody made it out safely. i'm told this girl is going into fifth grade and when she returns to school, she will be returning a hero. she can be credited with helping her entire family escape this morning's house fire. live in hayward, katie utehs, ktvu channel 2 news. >> thank you. the bay area woman known as the serial stowaway has been ordered to spend six months in jail for violating her

probation. marilyn hartman pled no contest to sneaking onto a southwest airlines flight from san jose to los angeles without a ticket. a judge released her and told her to away from the airport if she didn't have a ticket. the next day she was arrested again at l.a.x. she was given a stayaway order and two years probation trying to board planes six planes at sfo. a san jose city council has voted to schedule a hearing about security at the airport. they want staff, tsa and others to explain what is being done to improve the situation. the director of aviation said she will discuss the roles that airport employees play. >> the airport security hearing is september for september 25th. 8:45. in an exclusive interview with ktvu, we hear from the young man who almost lost his life after a frightening robbery in an area considered safe even by the police. pam cook is in the studio now with this incredible story and how you can help. >> 31-year-old jonathan penn was heading home from a night out with his girlfriend in campbell when they came face to face with a man with a gun. >> i was laying there about to die. >> it happened after midnight in early august near the pruneyard shopping center. penn said the man grabbed his girlfriend and tried to rob them. >> gave me all your money. i'm like what? and then i stand up and he's like boom, boom. >> penn was shot several times. one bullet narrowly missed his heart and he is still in the hospital. the man also shot at his

girlfriend but she was treated and released. now, police are looking for this man. he's described as latino in his 20s or 30s. officers say the same man may have also robbed a woman at the second street garage that same night, august 3rd. if you have any information, please contact campbell police. they tell us that this is a high priority case and that they are following up on several leads but so far no arrests have been made. dave and tori? >> all right. thank you, pam. want to go back to sal and take a look at the bay bridge toll plaza. how is it looking? >> it's okay. there is a little bit of a backup waiting to get on the bridge. it's about a 15, 20-minute drive time from here over to the san francisco side. nothing unusual on the bridge. it's just normal morning commute. 880, the same thing goes. it'sism proved a little bit. but -- it's improved a little bit but sticky from the oakland coliseum heading to downtown oakland. 580 westbound, we've had a couple of issues. but for the most part, it's beginning to lighten up approaching the interchange

into the livermore valley. let's go to steve. all right, sal. thank you. if you are heading out tonight, maybe dress in layers. there's more fog. a few high clouds wrapping around the low in oregon. these are not tropical clouds. they have come off the pacific. we have more fog, misty conditions. wear the layers. bundle up. it should be pretty warm once inside. maybe outor in some of the higher decks, you might feel pretty good. there's plenty of fog. most locations said, you know, the fog is a little thicker here today than it was the last couple of days. there's the low. you can see some of those higher clouds. it tails back in right there. that's what's coming across the higher clouds. there's also another low out here. it looks like a series of them over the next five, six days. we'll be meandering off the california coast keeping temperatures in check. there's no extreme showing up one way or another. had low 50s in the north bay. temperatures upper 50s, low 60s. the tropical clouds which have

been here forever and a day have finally pushed out of the state. there's nothing to be found. not even in arizona or southern nevada which has been dealing with tropical clouds since about july, it looks like. look how it pushes off into denver and points east. that's that low up in oregon, that flow. out of the picture here. but we do have some cooler conditions by the coast. it will be mild to warm away from the coast. maybe some of the morning mist or drizzle late tonight into tomorrow. highs more typical of what we should have this time of year. that's 60s, 7080s and 90s. petaluma, 82. 86 walnut creek. 71 alameda. 87 in livermore. that's exactly where they should be this time of year according to climatology. san jose, 82. the 83 in santa rosa is right on the money for this time of year. a little cooler, daly city, pacifica, hook, a little bit more fog. 72 san bruno to 82 redwood city. menlo park a soft 80. fog, son, cool, mild, warm. no big changes all the way into the weekend.

solidarity to the protesters in ferguson, missouri taking to the streets claiming police abuse. last night, police fired tear gas to break up another demonstration in ferguson. it was the fifth straight day of protests after the deadly police shooting of 18-year-old michael brown last saturday. news crews found themselves caught in the confrontation. a tear gas canister went off a few feet from a television reporter and his photographer. two journalists were arrested after videotaping police at a mcdonald's restaurant. one of the reporters who worked for the huffington post tweeted these pictures of the arrest. both reporters say they were handled roughly by police. neither reporter was cited, though, and they were later released. a tragic and mysterious cold case is getting new attention. it's now been ten years since a young couple was shot to death while sleeping on a remote beach in sonoma county. sheriff's deputies found the bodies of jason allen and

lindsey cutshall inside their sleeping bags on a beach near jenner. yesterday's lindsey's parents returned to the bay area from their hometown in ohio to mark this sad anniversary and came with a message for their daughter's killer. >> you will some day pay a price, whether here on earth or when you die or maybe both. >> the young couple worked as counselors at a christian youth camp in el dorado county. investigators say they get two or three tips every month in the search for the killer but no arrests have been made. 8:55. the chp cracking down on the rise in car thefts in the east bay. this week, police recovered 29 stolen cars in oakland. the chp says car thefts are a top priority because finding those stolen cars can often help solve other crimes. >> a lot of times when we find a stolen vehicle, the occupant has a warrant, maybe that's
